3. Why should I pay these assessments when Sites, West and Somerset Maple didn't keep their promises?

J&J Real Estate is not familiar with these individuals or Somerset Maple and any promises made and not kept.

The assessments are for the Water and Sewer that are completed and working. J&J Real Estate does not believe there is any legal right to not pay the annual assessments.

4. What are these fees and what is the Declaration you refer to?

When the project was first constructed, the Edelen Station water and sewer infrastructure was installed and paid for by the Developer, not the Local District. Pursuant to a Declaration filed with the County, the Developer is permitted to recover some of these costs from the owners over a period of 20 years. For a copy of the Declaration click here.

6. What will happen if I refuse to pay the assessments?

Section 4 of the Declaration allows J&J Real Estate to charge interest at the maximum rate permitted by law as well as late fees of 10% per month up to 3 months as well as attorney fees.

Additionally, the Declaration provides for the acceleration of all remaining installments.

Section 5 of the Declaration provides for a FIRST lien over the property. J&J Real Estate will not hesitate to use these remedies on delinquent accounts, and will aggressively pursue all remedies including foreclosure proceedings.
